When is an LMIA Not Required?

Intra-Company Transfers 

Employers transferring employees from one branch or subsidiary of their company to another in Canada may qualify for an LMIA exemption. This applies to executives, managers, or employees with specialized knowledge.

International Agreements

Positions that fall under international agreements, such as the Canada-United States-Mexico Agreement (CUSMA), may be LMIA-exempt. These agreements facilitate the temporary movement of professionals, traders, and investors.

Charitable or Religious Work

Employers hiring workers for charitable or religious activities are often exempt from the LMIA requirement. The roles must demonstrate a direct contribution to charitable or faith-based initiatives.

Significant Benefit

to Canada

Workers who provide a significant cultural, economic, or social benefit to Canada may be eligible for an LMIA exemption. Examples include entrepreneurs, researchers, and artists.

Employment

When Canadian workers have similar opportunities abroad, foreign workers can be hired in Canada without an LMIA. Examples include exchange programs, internships, or co-op placements.

Labour Market Impact Assessment (LMIA)

The Labour Market Impact Assessment (LMIA) is a document required by Canadian employers who wish to hire foreign nationals. It is issued by Employment and Social Development Canada (ESDC) to ensure that hiring a foreign worker will not negatively impact the Canadian labor market.
